Terms of Service

Last updated Oct 11, 2026

These Terms of Service ("Terms") are an agreement between you and Alertly ("Alertly", "we", "us"), the operator of the Alertly server and uptime monitoring service at http://localhost:8000 (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service for a company or other organisation, you confirm that you can accept these Terms on its behalf, and "you" means that organisation.

Please also read our Privacy Policy, Refund Policy and Acceptable Use Policy. They are part of these Terms.

1. The Service

Alertly monitors servers, websites and scheduled jobs and tells you when something goes wrong. Depending on your plan, the Service includes:

We may improve, change or remove features over time. If we remove a feature that is central to a paid plan, we will tell you in advance and you may cancel and ask for a refund of any unused prepaid period.

2. Accounts

Team owners decide who joins their team and what role each member has. Team owners and admins can see the team's servers, monitors, alerts and the names and email addresses of its members.

3. Plans, trials and payment

Our reseller: Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, invoices, receipts, tax and refunds are handled by Paddle under the Paddle Buyer Terms. We never see or store your full card details.

4. Cancellation and refunds

You can cancel at any time from Billing in your team settings. Your paid plan stays active until the end of the period you have already paid for, then your team moves to the Free plan. You will not be charged again.

Refunds are described in our Refund Policy. In short: if you are not happy, ask within 14 days of a payment and we will refund it in full.

If your team is over the limits of the Free plan after a paid plan ends, existing servers and monitors keep their data, but you cannot add more until you are within the limits or subscribe again.

5. Your data

You own the data you send to the Service, such as server metrics, monitor results, alerts, incidents and status page content ("Your Data"). You give us permission to store, process and display Your Data only as needed to run, secure and improve the Service for you, and as described in our Privacy Policy.

Public status pages are visible to anyone with the link, or on your custom domain. You decide which components and incidents they show.

You can export your data at any time from your profile, and delete servers, monitors, teams or your whole account. Metrics are kept for the history period of your plan and then deleted automatically.

6. Acceptable use

You agree to follow our Acceptable Use Policy. In particular, you may only monitor servers, websites and services that you own or have permission to monitor, and you may not use the Service to attack, overload or probe systems of others.

7. Availability and support

We work hard to keep the Service available and to deliver alerts quickly, but we do not guarantee that it will be uninterrupted or error-free, or that every alert will be delivered. Notifications rely on third parties such as email providers and chat apps that are outside our control. Alertly should be one part of your monitoring and incident response, not the only safeguard for critical systems.

We may carry out planned maintenance. When it may affect you, we try to announce it in advance.

Support is available by email at [email protected]. We aim to reply within two business days.

8. Suspension and termination

We may suspend or close an account if it breaks these Terms or the Acceptable Use Policy, puts the Service or other customers at risk, or if a payment fails and is not resolved. Where reasonable, we will warn you first and give you a chance to fix the problem.

You can stop using the Service and delete your account at any time from your profile. When an account is closed, teams it owns and their data are deleted, as described in our Privacy Policy.

9. Intellectual property

The Service, including its software, design and documentation, belongs to Alertly and its licensors. We give you a limited, non-exclusive, non-transferable right to use it while your account is active and within these Terms. The Alertly agent is open source and is also covered by its own licence.

If you send us feedback or suggestions, we may use them without any obligation to you.

10. Disclaimer

Except as required by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. AI-generated explanations and suggestions can be wrong; check them before acting on them.

11. Limitation of liability

To the extent allowed by law:

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence. If you are a consumer, you keep all rights you have under the consumer protection laws of your country.

12. Indemnity

If you use the Service for a business, you agree to cover our reasonable costs from claims by third parties caused by Your Data or by your use of the Service in breach of these Terms or the law.

13. Changes to these Terms

We may update these Terms from time to time. If a change is significant, we will tell you by email or in the app at least 30 days before it takes effect. If you keep using the Service after that, the new Terms apply. If you don't agree, you can cancel before the change takes effect.

14. General

These Terms are governed by the laws of the place where Alertly is established, without regard to its conflict-of-law rules. If you are a consumer, you can also rely on the mandatory laws of your country of residence and bring a claim in its courts. If a part of these Terms cannot be enforced, the rest stays in effect. Not enforcing a right is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger or sale of the business, and will tell you if we do.

15. Contact
